Personal Information Collection Statement (Prospective Candidates and Actual Employees)
This Personal Information Collection Statement (this “Statement”) is made by New World Development Company Limited (the “Company”, “NWD”,“we”, “us”, or “our”), and applies between us and you (“you”, or “your”). This Statement should be read together with the Terms and Conditions (if any) of the relevant mobile application operated by or on our behalf or hosting or running our service (if any) for or on our behalf (the “Application”), the relevant internal and/or external websites, software and/or platforms (including but not limited to at https://nwd.taleo.net/careersection/nwd_external/profile.ftl/ and other job application platforms) (the “Website”) (the “Terms and Conditions”) and other relevant legal documentations governing our legal relationship in the case of a successful candidate hire including but not limited to the employment agreement, the deed of confidentiality undertaking and employee’s handbook relating to personal data (if/where applicable) (the “Legal Documents”), provided that, in the event of any inconsistency between this Statement and the Terms and Conditions and/or the Legal Documents (if/where applicable)concerning matters relating to our handling of your personal data, this Statement shall prevail. In the event that you are submitting your job application or otherwise providing your personal data to us for use and processing for the relevant specified purposes as further listed below in this Statement through any external websites, software and/or platforms (including but not limited to Taleo, LinkedIn, JobsDB, CTgoodjobs, etc., as the case may be), please take note that your personal data will also be handled by those third party websites/software/platforms in accordance with their own privacy policy and personal data collection statement. Please read those third parties’ policies and statements carefully before providing your personal data to us through those third party channels.
This Statement shall apply whether or not your personal data (and any other related personal data such as those of your family members, if any and where applicable) (collectively, “Personal Data”) is provided to us through online and/or offline means (whether existing now or created in the future), whether or not such Personal Data is provided to us by you directly or through any other third parties including but not limited recruitment agencies, external job boards/websites/platforms, newspaper and media, and internal referral for recruitment purposes, and whether or not such Personal Data is directly provided to us, those external channels and/or to our relevant authorized third parties as further described below in this Statement in performing human resources management related functions.
The Company is part of the New World group of companies including NWD and its affiliated or related companies from time to time (as listed here: https://www.nwd.com.hk/pics) (the “New World Group”, or “NWG”) whose activities include real estate (sale, leasing and investment), mortgage services, retail, property management, facilities management, activity planning and management, infrastructure, shopping malls, loyalty programmes, department stores, jewelleries and luxury products, e-commerce, hospitality services, food and beverages, convention and exhibition centres, sports and recreational facilities, education, health care and senior care, other health and wellness products and services, financial services and insurance, transportation, sustainability programmes and products, TMT (Technology, Media and Telecom), corporate innovation, accelerator and incubation programmes, organization of competitions, conferences and events, start up and social innovation programmes and charitable pursuits including sports, recreation, art and cultural programmes, relief of poverty, advancement of education, advancement of religion, and other purposes that are beneficial to the community (the “Goods and Services”) (the New World Group and joint venture companies together referred to as “Affiliates”).
In order to enable us to perform the Purposes (as defined in the “Purposes for using Personal Data collected” below), you are required to provide all the requested/mandatory Personal Data in the application form or the personal record form (as the case may be). If you do not provide the required Personal Data, then we may not be able to perform the Purposes and/or (subject to your consent) provide relevant goods and/or services to you.
Kinds of Personal Data
The kinds of Personal Data we may collect from you and/or from other sources as mentioned in this Statement include but are not limited to your full name both in English and Chinese, nick name, title/salutation, job position, gender, age (or age range), date, month and year of birth, photograph, facial features and related biometric data (if/where applicable), contact details, e-mail address, fax, mailing/ residential/correspondence address, contact number, employee/staff number (if any), marital status, family status, nationality, place of residence, educational level and history, academic and professional qualifications and memberships, occupation and employment history, background check information and records, information generated by your participation in psychological, technical or behavioral assessments related to your job application , salary information (including but not limited to salary proof such as pay slip and employment contract), username and password, identification document number including but not limited to Hong Kong Identity (“HKID”) card, passport and Mainland travel permit, group life insurance beneficiaries’ name and their HKID card or passport number, emergency contact person’s name, legal relationship with you, gender and contact number, bank account information including name of bank, name of account holder, bank code and bank account number, health/medical records, tenancy/leasing agreement and rental receipts (if/where applicable), documentation required under immigration laws in Hong Kong (if/where applicable), Log Files (see below),interests and favourite activities, personal preferences or comments, tracking information about your use of the Application and/or the Website and transaction information (including your characteristics and transaction behaviour) (“Tracking Data”), social media account information, etc. For Tracking Data collected through the use of cookies and other tracking mechanisms, please also refer to our related policies (including but not limited to the New World Group Privacy Policy Statement and Cookies Policy) for further details as to how we collect, use and process Tracking Data.
Whilst the above paragraph provides a general overview of the kinds of Personal Data that may be collected and processed, the actual kinds of Personal Data that we will collect and process in practice will vary in each case depending on your role, position and/or relationship with us, i.e. whether you are a job applicant (whether successful or unsuccessful candidate) and/or an employee, as the case may be. For further information about the specific kinds and clusters of Personal Data that we will collect for candidates, employees and/or candidates and employees, as the case may be (and the corresponding Purposes, as further defined below) that those Personal Data will be used for), please refer to the table in Appendix 1.
To the extent that you are a successful hire and are eligible to apply for the Company’s medical benefits in favour of your legal spouse, your children and/or your parents, and/or for tax return purposes, the kinds of Personal Data we may collect (whether directly or indirectly) from you and/or from other sources as mentioned in this Statement (and submitting for and on behalf of your legal spouse and/or your children and/or your parents), where applicable, include but not limited to their names, HKID card or passport numbers, birthday information, gender, legal relationship with you, occupation, name of their employer or business (as the case may be).
Purposes for using Personal Data collected
The Personal Data to be collected from you will be used and retained by us (and/or our Affiliates and/or our Marketing Partners as defined in the “Direct marketing” section below, as applicable) for the following purposes (as may be applicable from time to time) (together, the “Purposes”), and for more information as to which of the relevant Purposes that your Personal Data will be used for depending on whether you are a job applicant (whether successful or unsuccessful) and/or an employee (as the case may be), please refer to the table in Appendix 1:
- Assess your suitability to assume the job duties of the position applied for (whether with us and/or with any of our relevant Affiliates under the New World Group, as the case may be);
- Our existing and/or future recruitment exercise (including existing and/or future recruitment exercise of or for our Affiliates) and in this connection it is our policy to retain the Personal Data of unsuccessful applicants for future recruitment exercise for a period of two years (the “Retention Period”) (unless you have also consented to our use of your Personal Data for direct marketing, in which case your Personal Data will be retained for such purpose);
- To carry out pre-employment and post-employment background verifications, reference checks and medical checks, and handling of the relevant records and information relating thereof for or in relation to such purposes;
- To facilitate and perform staff training and development, and other human resources management related functions from time to time via any form, format, media or medium (whether online and/or offline, whether now existing or introduced in the future), including but not limited to providing you (and your family members, if/where applicable, as the case may be) with the relevant staff rewards, compensations and benefits (in any case subject to eligibility and/or availability at our sole discretion), conducting staff performance review and appraisal, team management and succession planning, staff planning, promotion planning, conflict of interest checking, tax reporting, staff training and development, and/or disciplinary investigations;
- For employees who are entitled to rental reimbursement, for handling of tax and related financial and administrative matters in relation to employees’ tenancy/leasing agreement and rental receipts;
- To facilitate and manage the relevant corporate and employee financial matters, including but not limited to matters of management and administration of staff payroll, commission, bonus, tax, disbursements and expense claims and reimbursements, arrangements on the relevant employee retirement protection scheme (e.g. mandatory provident fund (MPF), occupational retirement scheme (ORSO), pension and/or any other applicable retirement scheme, as the case may be), etc.;
- If/where applicable and subject to your consent, identifying and verifying your work attendance and for office security management purposes through different means, including but not limited to, facial features and related biometric data;
- Research and development in relation to human resources management;
- Identifying and verifying your identity and/or as an employee and/or a member of any of the loyalty programmes or clubs run, hosted or organised by companies of New World Group(as the case may be);
- Registering you as a user of the Application and/or the Website and/or any other online and/or offline channels as an employee and/or a member (as the case may be);
- To serve you better and/or maintain your Personal Data and/or information across multiple pages within or across one or more sessions when using the Application and/or the Website and/or any other online and/or offline channels, where applicable;
- Following registration as a user as an Applicant/ employee and/or a member, accessing your account information (including, but not limited to, your name, account user name, employee’s number, membership number, etc.) and managing your account (including, but not limited to, changing your password, updating your personal information, processing your option for subscribing/unsubscribing from direct marketing, etc.);
- Subject to your consent for direct marketing, if/where applicable, research, development, and analysis in relation to your behaviour as employee and/or customer (as the case may be) including carrying out data sorting and analysis to enable us to better understand your characteristics and transaction behavior, to provide other goods and/or services better tailored to your needs, and to assist us in selecting Marketing Subjects (see below) that are likely to be of interest to you, and carrying out aggregated behavioural analysis, including using Personal Data for statistical analysis, data science studies and data mining;
- For you to make enquiries, complaints, and/or suggestions to us in relation to the Purposes and/or the Goods and Services (including, but not limited to, through an in-app text box on your mobile device or through our official social media page and/or our official website of, or by text message, email and/or mail, and/or other media whether now known or available in the future);
- Seeking your feedback, including through surveys, in relation to the Purposes and/or the Goods and Services (including, but not limited to, through an in-app text box on your mobile device or through our official social media page and/or our official website of, or by text message, email and/or mail, and/or other media whether now known or available in the future);
- Improving the Application, the Website and/or any other online and/or offline channels, the Purposes, and our and our Affiliates’ and Marketing Partners’ Goods and Services;
- Direct marketing and cross-marketing for the Marketing Subjects, subject to consent (see below section entitled “Direct marketing”);
- Data analytics, profiling, information management and database administration;
- Deterring, detection, investigation and/or prevention of activities that may violate, or may be suspected to violate, our policies or may be abusive, illegal, and/or criminal;
- Collection or recovery of any debt owed by you to us and/or our Affiliates;
- The normal management, operation, and maintenance of the Application, the Website, and/or any other online and/or offline channels and (subject to your consent for direct marketing, if/where applicable) the provision of the Goods and Services to you;
- Storing your Personal Data (whether by a single or multiple Affiliates (including us) or our Marketing Partners) for the purpose of sharing such Personal Data with our Affiliates and/or our Marketing Partners for any and all of the other Purposes listed above (and subject to your consent in the event that transfer to any or all such data transferees for direct marketing are involved); and/or Other purposes ancillary or related to the above.
Those with whom we share Personal Data
We may engage agents, contractors, vendors, suppliers, public and governmental authorities, service providers and/or professional advisors (whether within or outside the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”)) in connection with the relevant applicable Purposes and/or the provision of the Goods and Services, including but not limited to, e.g. human resources services providers, background and reference check services providers, recruitment agencies, insurers, bankers, body check service and/or medical practitioners providing medical services for our prospective and/or actual employees, provident fund managers, staff union, staff benefits service providers, your actual or potential future employers, IT/software solutions/technology services providers, accounting, auditing, consultancy, taxation or legal services providers, travel agents and travel agencies, marketing agents, social media, research companies, and service providers of development and maintenance, administrative, data processing, digital storage, or other similar services, and may transfer to or share your Personal Data with them to the extent as needed for the relevant applicable Purposes within or outside Hong Kong. We may also share your Personal Data subject to your consent, if/where applicable, with our Affiliates, our Marketing Partners (see below) and the social media platforms that we and/or our Affiliates/our Marketing Partners (see below) use for such Purposes, and for the avoidance of doubt, we will share and transfer your Personal Data to our relevant Affiliates that are involved in the relevant existing and/or future recruitment exercises referred in the Purposes for their further handling. Where we are required by the law of any country or place or requested by any court, regulatory body or governmental body of any country or place, we may also disclose your Personal Data as required. In the event of any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer, or purchase of us or our business or our Affiliates or our Affiliates' businesses, your Personal Data may be transferred to the new entity as part of the transaction, provided that the new entity abides by this Statement and continues to exercise the same level of care, in respect of your Personal Data, as we would. You will be notified of such event and you may decide to withdraw your consent to the use of your Personal Data.
Your Personal Data may be stored by us in physical locations and/or servers located within or outside Hong Kong and/or shared with our Affiliates and/or our Marketing Partners (see below) located within or outside Hong Kong. However, we will take all reasonable measures to ensure that your Personal Data is stored and processed securely, regardless of the country or place in which it is stored, and we procure by contract or use our reasonable endeavours to ensure that our Affiliates and our Marketing Partners (see below) do the same.
Direct marketing
Subject to your consent, we may use your Personal Data to send you direct marketing (including, but not limited to, special offers, news, information and marketing) about us, our Affiliates and/or our Marketing Partners (see below) in relation to the Marketing Subjects (see below) whether by in-app messages and/or notifications and/or push notifications to your mobile device, post, email, telephone, text message, or other media whether now known or available in the future. For the avoidance of doubt, we will not use your biometric data for direct marketing purposes.
Subject to your consent, we may also use your Personal Data for, or provide your Personal Data to, our Affiliates and/or our Marketing Partners (see below) so that they may send you direct marketing (including, but not limited to, special offers, news, information and marketing) about us, our Affiliates and/or our Marketing Partners (see below) in relation to the Marketing Subjects (see below) whether by in-app messages and/or notifications and/or push notifications to your mobile device, post, email, telephone, text message, and/or other media whether now known or available in the future.
Our “Marketing Partners” include property developers, banks, financial and investment institutions, insurance companies, private clubs, concierge and customer service providers, retail outlets and online businesses (products and services including fashion and beauty, health and personal cares, luxury, home and living, food, wine and beverage, books and stationery), shopping malls, department stores, watches and jewellers (such as Chow Tai Fook Jewellery Group Limited), hotel chains, catering services providers, healthcare and senior care, services and/ or products providers including health and wellness, art and culture, gallery and exhibition, green and nature, sports and recreation, travel and accommodation, leisure and entertainment, transportation and logistics, telecommunication, media and information technology, corporate innovation, accelerator and incubation programmes, competitions, conferences and events, pre-school, primary, secondary and/or tertiary education and institutions.
As we may share your Personal Data with our Affiliates and/or our Marketing Partners, we may also receive your Personal Data from them. Subject to your consentgiven to our Affiliates and/or our Marketing Partners, we may also use such Personal Data to send you direct marketing about us, our Affiliates and/or our Marketing Partners in relation to the Marketing Subjects (see below).
The types of products, services, events and charitable initiatives that we, our Affiliates and/or our Marketing Partners may market to you include the following (together, the “Marketing Subjects”):
goods and services offered by us and/or our Affiliates in relation to the Goods and Services;
- goods and services offered by us and/or our Affiliates in relation to the Goods and Services;
- finance, banking, mortgage, insurance and other related services and products by banks, financial and investment institutions and insurance companies;
- access and privileges at private clubs;
- professional consultation on customer services, including but not limited to event planning, holidays, hotels, travel, and tickets reservation;
- consumer products and services by retail outlets and/or online businesses, including clothing, shoes, fashion, fashion accessories and beauty, health and personal cares, luxury, home and living, household products, food, wine, liquor and beverages, confectionary, groceries, books and stationery, toys, cigarettes and cigars, fragrances and cosmetics, baby products, telephones and mobile devices, electronics and electrical appliances, computer software, and games, bags and luggage, furniture, sports and leisure equipment;
- pharmaceutical products, medical and pharmaceutical services, therapists;
- tutoring, mentoring, home cleaning, janitor services, landscape and plant maintenance services, agricultural services, part time housekeeping, plumbing services, locksmiths, barber and salon services, gym and fitness services, laundry services, florists, vehicle towing, and motor vehicle services;
- reward, loyalty, privileges programmes and promotions at shopping malls and department stores;
- reward, loyalty, privileges programmes and promotions for customers and/or potential customers of the New World Group;
- watches, jewelleries and accessories;
- restaurants, catering services on food, wine and beverage;
- travel, hospitality and accommodation services and products, including but not limited to hotels and serviced apartments, holiday package products and services offered by travel agents, tickets to attractions;
- transportation and logistics services, including but not limited to air travel and non-air transportation services such as hotel transfers, car rentals, bus operators, train operators and cruise operators, and courier services and shipping services ;
- conference and exhibition management services, consultancy and marketing research services, supply chain management, event and project management services, gaming services, advertising and public relations services, media production services;
- tickets for concerts, galleries, exhibitions, films, theatricals, sporting, special and cultural events;
- green and nature activities;
- technology, telecommunication, internet and mobile communication services, social networking and media;
- graphic and interior design services, photography services, printing and publishing services;
- legal services, medical services, accounting, auditing, bookkeeping and taxation services, engineering services, architectural services, surveying services, equipment rental services, hospitality services;
- professional advice and/or consultation on education and/or personal enhancement;
We cannot use or provide your Personal Data for direct marketing purposes and/or provide your Personal Data to any third parties (whether to our Affiliates and/or our Marketing Partners) for their direct marketing purposes unless you consent. Your consent or withholding or withdrawal of your consent on direct marketing will not affect your present or future job application (and where applicable, our functions and activities for or relating to human resources management including but not limited to assessment of your job application, job performance and/or any other human resource matter during or after employment, as the case may be). Even if you give your consent, you can opt out of direct marketing at any time (or you may request that we cease to provide your Personal Data to third parties, at which point we will cease to do so), free of charge, by emailing privacy_HR@nwd.com.hk or writing to our Personal Data Privacy Officer at 30th Floor, New World Tower, 18 Queen’s Road Central, Hong Kong (marked Confidential).
Your rights
Apart from your right to opt out of direct marketing as mentioned above, subject to and in accordance with the relevant legal requirements and relevant best practices of the Privacy Commissioner, you have the following additional rights to:
- check whether we hold any of your Personal Data;
- access your Personal Data held by us;
- require us to correct any Personal Data which is inaccurate; and
- ascertain our policies and practices (from time to time) in relation to Personal Data and the types of Personal Data held by us.
If you would like to make a request in relation to the above (or make any general enquiries), please contact our Personal Data Privacy Officer at 30th Floor, New World Tower, 18 Queen’s Road Central, Hong Kong or privacy_HR@nwd.com.hk (marked Confidential). In accordance with the Personal Data (Privacy) Ordinance (Cap. 486, Laws of Hong Kong) (the “PDPO”), we have the right to charge you a reasonable fee for the processing of any Personal Data access request.
Privacy Policy Statement
We adopt the New World Group Privacy Policy Statement to the extent that you are using the Application and/or the Website. You can find out more about our policy on personal data protection by accessing the New World Group Privacy Policy Statement available at http://www.nwd.com.hk/privacy-policy. If there is any inconsistency or conflict between the New World Group Privacy Policy Statement and this Statement, this Statement shall prevail.

Inconsistency or conflict

Miscellaneous
This Statement may be updated from time to time to reflect changes to our policy with respect to personal data protection and/or changes to personal data/data privacy laws and regulations. Where there are significant changes, we will notify you and obtain your acceptance of the changes, consents, and/or opt in (as necessary or applicable). If you do not accept the changes and/or provide your consent, then we may not be able to perform the Purposes and/or provide goods or services to you. You are advised to check the Application and/or the Website (as the case may be) for updates to this Statement on a regular basis.
Nothing in this Statement shall limit your rights under the PDPO.
This Statement shall be governed by, and construed in accordance with, the laws of Hong Kong.

- 识别及验证您的身份及╱或作为雇员及╱或新世界集团旗下公司营运、主办或举办的任何会员计划或俱乐部的成员（视情况而定）；
- 将您作为雇员及╱或成员（视情况而定）注册为应用程式及╱或网站及╱或任何其他线上及╱或线下渠道的用户；
- 在适用的情况下，在使用应用程式及╱或网站及╱或任何其他线上及╱或线下渠道时，为您提供更好的服务及╱或在一个或多个场节内╱之间将您的个人资料及╱或资料保存在多个页面；
- 注册为程式申请人╱雇员及╱或会员后，读取您的帐户资料（包括但不限于您的姓名、账户用户名称、雇员编号、会员编号等）并管理您的帐户（包括但不限于更改您的密码、更新您的个人资料、处理您订阅╱取消订阅直接促销的选择等）；
- 在您同意直接促销（如适用）的情况下，与您作为雇员及╱或客户（视情况而定）的行为相关的研究、开发及分析，包括进行数据排序及分析以使我们进一步了解您的特点及交易行为、以便我们按您的需要提供其他个人化商品及╱或服务及以助我们为您挑选您可能感兴趣的营销主题（见下文），及进行行为分析整合，包括运用个人资料作统计分析、数据科学研究及资料探勘；
- 您可以就目的及╱或商品与服务向本公司查询、投诉及╱或提出建议（包括但不限于通过流动设备上的应用程式内文讯息或通过本公司官方社交媒体页面及╱或本公司官方网站，或通过短讯、电邮及╱或邮件，及╱或现已存在的或者将来可能出现的其他媒体）；
- 通过调查等方式获取与目的及╱或商品与服务相关的反馈（包括但不限于通过流动设备上的应用程式内文讯息或通过本公司官方社交媒体页面及╱或本公司的官方网站，或通过短讯、电邮及╱或邮件，及╱或现已存在的或者将来可能出现的其他媒体）；
- 改进应用程式、网站及╱或任何其他线上及╱或线下渠道、目的以及本公司及本公司的关联公司及本公司的营销合作伙伴的商品与服务；
- 经同意后，就营销主体进行直接促销及交叉促销（见下文标题为「直接促销」的部分）；
- 数据分析、研究、资料管理及数据库管理；
- 阻止、侦查、调查及╱或预防可能违反或可能疑似违反本公司政策或可能涉及滥用、非法及╱或犯罪行为的活动；
- 收取或收回您欠本公司及╱或本公司的关联公司的任何债务；
- 应用程式、网站及╱或任何其他线上及╱或线下渠道的正常管理、运营及维护以及（在您同意直接促销的情况下（如适用））向您提供商品与服务；
- （由一个或多个关联公司（包括本公司）或本公司的营销合作伙伴）存储您的个人资料，以便与本公司的关联公司及╱或本公司的营销合作伙伴为上述任何及所有其他目的共享个人资料（及如果涉及转让予任何或所有该等资料受让人作直接促销用途，则须经您同意）；及╱或
- 上述目的之其他辅助目的或相关目的。
我们分享个人资料之第三方

您的权利
除上述您选择退出直接促销的权利外，根据及按照相关法律规定及私隐专员的相关最佳行事方式，您拥有以下额外权利：
- 检查我们是否持有您的任何个人资料；
- 查阅我们持有的您的个人资料；
- 要求我们更正任何不准确的个人资料；及
- 确定我们关于个人资料及我们持有的个人资料类型的不时生效的政策及做法。
